Guns on hold once again

A St. Louis circuit judge puts his foot down, saying no to conceal and carry once more. Ann Hynek has the story.

In the case of Alvin Brooks v. the state of Missouri, Brooks is today triumphant.

The decision made by Circuit Judge Steven Ohmer declared conceal and carry unconstitutional.

Burt Newman, co-counsel for the Plaintiff, says they're satisfied with today's ruling.

Contents: Newman says that throughout litigation, they've argued that the law is unconstitutional, and today, Judge Ohmer agreed. The framers of the Missouri Constitution clearly prohibited concealed weapons.

Today's ruling extends a preliminary injunction against concealed weapons from October tenth, the day before concealed weapons were scheduled to become legal.

Missourians who wanted a permit for concealed weapons have to wait even longer.

Circuit Judge Steven Ohmer decided that conceal and carry is unconstitutional.

Scott Holste, spokesman for Attorney General Jay Nixon, says they will dispute Ohmer's decision.

Contents: Holste says after the decision came down, the attorney general filed their appeal. The Attorney General's office is asking the Missouri Supreme Courth to expedite the matter so there can finally be a decision on conceal and carry.

The conceal and carry law was supposed to go into effect October eleventh.

Now it's up to the Missouri Supreme Court to decide if it will go into effect at all.
