Resolution to block the Federal health care bill filed.

Intro:  Missourians would get to vote on President Obama's health care plan under a resolution filed this week. Allison Blood has more from Jefferson City.

Wrap: Cynthia Davis, Republican Representative from O'Fallon filled a resolution saying Missourians should vote on whether or not the federal health care bill will apply to them.

Description: "So what this bill essentially does is it says we are going to maintain our right to purchase health care however we choose, regardless of what they come up with."

Davis says the federal government has no constitutional right to regulate health care to the extent they plan to, and her bill would preserve the rights of the states.

University of Missouri Political Science Professor Greg Casey says her resolution is in fact unconstitutional because any state law in conflict with federal law is void under the United States Constitution.

Wrap: Republican Representative Cynthia Davis filed a resolution giving Missourians a chance to vote if they would be subject to a federal health care plan.

University of Missouri professor Greg Casey says it doesn't matter if this resolution passes a vote of Missourians.

The supremacy clause of the US Constitution mandates any state law contradicting a federal law will become void.

Davis says her resolution is constitutional under the 10th Amendment which reserves the rights of states to govern their citizens.
