Wrap: The House committee planned to discuss the Department's procedures regarding excution protocols and the procurement of the execution drugs. However, Lombardi sent word hours before the hearing that he would not be in attendance.

Barnes said Lombardi's absence was disappointing but the issue is not going away.

Actuality:  BARNES1.WAV
Run Time:  00:07
Description: This committee has never held a one sided hearing and we aren't going to get in that practice if we can avoid it.

But, Barnes said if the director continually refuses to offer a time and a date at which he can be available for testimony they will hold the hearing without him.

The Department of Corrections could not be reached for comment.
